Our Approach to Disputes

Wallies LLC believes in resolving disputes efficiently and fairly. This page outlines the dispute resolution process for users of Wallies.

Step 1: Contact Us Directly

Most issues can be resolved quickly by contacting our support team. Please reach out first before pursuing formal dispute resolution:

Response Time: Within 48 hours

Step 2: Internal Escalation

If you're not satisfied with the initial response, you may escalate to our management team:

Include: Account details, issue description, desired resolution

Pending legal counsel review: The arbitration, class-action waiver, and opt-out provisions below are under review by legal counsel and may be revised. Material changes will be announced in advance.

Step 3: Binding Arbitration (US Users)

For US-based users, disputes that cannot be resolved through direct contact will be settled through binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association (AAA).

Arbitration Agreement

By using Wallies, you agree to arbitration instead of court litigation, except:

  • Small claims court actions (under $10,000)
  • Intellectual property disputes
  • Injunctive relief for Terms violations

Alternative Dispute Resolution (EU Users)

EU/EEA users have access to the European Commission's Online Dispute Resolution (ODR) platform:

EU consumers retain all rights under applicable consumer protection laws, regardless of arbitration clauses. You may bring disputes before the courts of your EU member state.

Class Action Waiver

Disputes must be brought individually. You waive the right to participate in class actions, class-wide arbitrations, or representative proceedings. This waiver does not apply where prohibited by law (e.g., certain EU consumer rights).

Costs & Fees

For disputes under $10,000, Wallies LLC will pay all AAA arbitration fees. For larger disputes, fees are split according to AAA rules. The prevailing party may be awarded attorney's fees at the arbitrator's discretion.

Governing Law

These dispute resolution terms are governed by:

  • US Users: Laws of the State of Florida, excluding conflicts of law principles
  • EU Users: Consumer protection laws of your country of residence take precedence

Opt-Out (US Users Only)

You may opt out of the arbitration agreement within 30 days of account creation by sending written notice to:
